Can you keep chickens in Fuquay-Varina?

Thinking about raising a few backyard hens in Fuquay-Varina? The Town welcomes egg-laying hens on most residential lots, but keeps a tight rein on flock size, coop placement, and rooster ownership. Here's what Peggy's Happy Chickens found after reading the Town's actual ordinance.

Yes – with conditions

Yes, backyard hens are allowed in Fuquay-Varina, but the rules differ depending on whether the property is inside the Town's corporate limits or in its Extraterritorial Jurisdiction (ETJ). Under the Town's Land Development Ordinance (§9-1255, Article F, Use Standards), chickens kept as an accessory use (not part of a bona fide farm) are permitted on single-family lots in the Residential Agricultural (RA), Residential Low Density (RLD), Residential Medium Density (RMD), Residential High Density (RHD), and Planned Unit Development (PUD) zoning districts.

Corporate Limits: A maximum of five (5) hens is allowed. ETJ: up to 10 hens are allowed on lots under 2 acres, and there is no numeric cap on lots 2 acres or larger. Roosters are prohibited town-wide.

A Chicken Coop & Pen Permit is required from the Town's Planning Department, including a plot plan showing the coop/pen location and setback dimensions from all property lines.

The rules, straight from the municipal code.

  • Permit: A Chicken Coop & Pen Permit application must be submitted to the Planning Department with a plot plan showing the coop and pen location, dimensions, and setbacks from all property lines.
  • Location: The coop and pen are only permitted in the rear yard and must maintain a minimum setback of 15 feet from side and rear property lines. The coop/pen must be located closer to the owner's principal structure than to any adjacent neighbor's principal structure, and cannot be located in any buffer, landscape easement, stormwater management area, conservation easement, or utility easement.
  • Size limits (Corporate Limits): The coop may not exceed 12 feet by 12 feet, and the pen may not exceed 300 square feet. In the ETJ, there is no minimum or maximum size requirement for the coop or pen.
  • Construction: The coop must be designed to secure chickens at night with proper ventilation, shelter, and protection from weather and predators. The pen must be enclosed on all four sides with fencing at least 6 feet high with a self-latching gate, and the coop must be located within or attached to the fenced pen.
  • Maximum hens: 5 hens in the corporate limits; up to 10 hens in the ETJ on lots under 2 acres; no numeric limit in the ETJ on lots 2 acres or larger. Roosters are prohibited everywhere in Town jurisdiction.
  • Personal use only: Eggs, chicks, adult chickens, processed chickens, and chicken-manure compost may not be sold from the property.
  • Maintenance: The coop must be kept clean and sanitary, on-site slaughter of chickens is prohibited, and any chicken that dies of causes other than slaughter must be bagged and disposed of with household waste.
  • HOA note: Homeowners should also check their HOA covenants or deed restrictions, as private restrictions may be stricter than Town rules.
